Legislative Updates

National Minimum Wage (NMW)

The NMW rates, effective from 1st April 2017, are:

  • 21 to 24 years old get £7.05 per hour

  • 18 to 20 years old get £5.60 per hour

  • 16 to17 years old get £4.05 per hour

  • £3.50 for apprentices under 19 or 19+ who are in the first year of apprenticeship.

National Living Wage (NLW)

From April 2016, the government will introduce a new mandatory National Living Wage (NLW) for workers aged 25 and above.

 

The premium will come into effect on top of the NMW, taking the National Living Wage to £7.50 from 1st April 2017. The NMW will continue to apply for those aged 21+, with the premium added on top for more experienced workers taking the total hourly rate to the National Living Wage.

Workplace Pensions (Northern Ireland)

A workplace pension is a way of saving for our retirement arranged through your employer. You will be automatically enrolled in a workplace pension if you:

  • are aged 22 or over

  • are under State Pension age

  • earn more than £10,000 a  year

  • work in the UK

 

Employers need to...

All employers will have to provide workers with a workplace pension scheme by law over the next few  years. The biggest employers started doing this in October 2012  (aka "staging date").
            
If you don’t already offer workers a workplace pension scheme, you must make the necessary arrangements before your business’s staging date. You will receive a letter from the Pensions Regulator 12 months before your staging date, confirming your staging date and outlining the support available to you.
            
Riada Resourcing's staging date was 1st April 2014. This means all temporary workers are automatically enrolled from this date.

Agency Workers Regulations (AWR)

The AWR legislation will come into operation on 5 December 2011, giving Agency Workers the right to the same basic employment and working conditions as if they had been recruited directly, if/when they complete a qualifying period of 12 weeks in the same job.

 

Employers need to...

Complete our AWR questionnaire for each temporary role you have with Riada (request a copy from the Riada Team).We will monitor and keep you on track after this.

Fair Employment & Treatment (NI) Order 1998

Employers and service providers have duties and obligations under equality laws. Employers must provide equality of opportunity on grounds of:

  • age

  • disability

  • sex

  • race

  • religious belief

  • political opinion

  • sexual orientation

  • gender reassignment

 

Employers need to...

Requires private employers in Northern Ireland with 10+ employees and public authorities to:

  • Register with Equality Commission

  • Monitor community background, sex and occupation of workforce

  • Conduct Art 55 reviews every 3 years

  • Take affirmative action to ensure fair participation from different community backgrounds.
